Translation (English-Hindi) Exercise - 36 (28-06-2021)

 Today,  when  I  interact with a group of people who are teachers as well as parents who have a responsibility of guiding young adults - who are going to be the future of our Country. As we look around we often hear the word from students, teachers, parents "We are stressed" In earlier times the common refrain for the student community was"Busy with studies" and now this simple term has given way to the sickly term"Stressed out" which has become almost an epidemic today, and all the three -- Students, Teachers and the Parents have fallen victims to it.

Let me begin with the fact that problem solving is at the very core of our holy scriptures like "The Holy Gita" which is essentially a dialogue between Bhagwaan Shri Krishna and Arjuna where Krishna answers the questions that arise out of the inner turmoil of Arjuna restraining him to attack his very own relatives, the very fact that Arjuna ultimately enters the war as Bhagwaan Shri Krishna satisfies his queries, stands testimony to that fact that problems are to be faced and solutions found. It is the same role that a parent has to play for his daughter/son. Is it not a dichotomy that when the world comes to us to learn "how to de-stress" we ourselves are falling victims to stress? Here is how we landed in this soup, in earlier times there were joint families where a kid could go to any family member for advice, now she/he has parents and siblings and all of them are busy with their lives so who does one go to? Apart from this apparent lack of advice a child has to tow the burden of her/his parents' aspirations, who by providing her/him all the facilities wait for the magic to happen. Who will realize that the child is feeling helpless under this stress? Luckily we have trained counselors, Psychologist who can fill this gap. Still the biggest source of inspiration and motivation for a child is his immediate family.

Come to think of it that the problem has acquired such a monstrous shape that the Prime Minister of our country has to take out two hours from his busy schedule to speak to the student's community emphasizing the need to stay stress-free for the sake of better performance. Herein lies a lesson for the Parents as well as the Teachers that the responsibility of helping our children lies with us, parents by realizing that they should not put the burden of their own aspirations on their children and Teachers should keep using the power of encouragement by constantly boosting the morale of their students.

So what is Stress and how to take care of it? I am going to be focusing on how this is leading to a more grimly term called "depression" for the student community.

कोरोना और रिश्‍तों की टूटती डोर

कल, एक मित्र ने घटना बताई। एक परिवार में तीन भाई और उनके परिवार तथा तीनों भाइयों के पिता थे। दो भाई अपने-अपने परिवार सहित अलग-अलग शहरों में रहते थे। सबसे छोटा भाई छोटी-मोटी प्राइवेट नौकरी करके 20-25 हजार रूपये महीना कमाता था। इन भाईयों के पिता पेंशनर थे और सबसे छोटे भाई के साथ के साथ रहते थे। इस तरह  सबसे छोटे भाई और पिता का सही गुज़ारा चल रहा था। दोनों बड़े भाई भी बुजुर्ग पिता की जिम्‍मेदारी से मुक्‍त थे।  कोरोनाकाल में एक दिन अचानक बुजुर्ग पिता की तबीयत बिगड़ी और टेस्‍ट करवाने पर कोरोना पॉजिटिव पाए गए। अभी घर में इलाज शुरू ही किया था कि दूसरे-तीसरे दिन ही उनकी मौत हो गई। पिता की मौत के साथ ही सबसे छोटा भाई गहरे सदमे में चला गया। सोचने लगा कि अब उसका घर कैसे चलेगा।  इस बीच, किसी के सुझाव पर सबसे छोटे भाई ने कोरोना टेस्‍ट करवाया। पिता के अंतिम संस्‍कार के लिए दोनों भाईयों को बुलाया गया। वे अपनी-अपनी गाड़ी से छोटे भाई के घर पहुंचे। तीनों भाइयों और आस-पड़़ोस के दो-तीन लोगों ने मिलकर बुजुर्ग पिता का संस्‍कार किया। बुजुर्ग की मृत्‍यु के तीसरे दिन तीनों भाई श्‍मशन से अस्थियां चुनकर लौट रहे थे तो टेस्‍ट पता चला कि सबसे छोटा भाई भी कोरोना पॉजिटिव है। ऐसे में, दोनों भाईयों ने छोटे भाई के घर के अंदर जाने से मना कर दिया और पंडित जी से तीसरे दिन ही सभी रस्‍में पूूूूरी करवा लीं और उसी दिन वापिस लौट गए। सबसे छोटा भाई डिप्रेशन के रसातल मेंं जा चुका था। दोनों भाई कुछ किलोमीटर ही गए होंगे कि उन्‍हें खबर मिली कि उनका सबसे छोटा भाई इस दुनिया में नहीं रहा।

कोरोना त्रासदी : क्‍या खोया ... क्‍या सीखा

कोरोना .... एक ऐसा नाम ... ऐसा शब्‍द जो आज रौंगटे खड़े कर रहा है। हम अपने आसपास के लोगों को इस काल के मुँह में समाते हुए देख रहे हैं। इलैक्‍ट्रोनिक एवं सोशल मीडिया पर कोरोना पीडि़तों के परिवारों  को खून के ऑंसू रोते हुए देखना हमारे शरीर में सिरहन पैदा कर जाते हैं। ऐसे परिवार हैं जो सबकुछ लूटा कर अपनों को जिंदा देखना चाहते हैं तो वहीं कुछ ऐसे बदनसीब गरीब भी हैं जो अस्‍पतालों का मुँह तक नहीं देख पा रहे हैं। कोरोना किसी के लिए काल तो किसी के लिए चांदी काटने का अवसर बन रहा है। कोरोना की बलि चढ़ने वाले शरीरों की आत्‍माएँ अपने शरीरों के साथ होने वाले हश्र और अपनों के पास न आ पाने की मज़बूरी को देखकर रो रही हैं ... सिसक रही हैं ... भगवान से अपनों की रक्षा की गुहार लगा रही हैं। 

हमने कोरोना त्रासदी में अनेक विभूतियों को खोया है। किसी ने अपनी माँँ .. बाप ... भाई .. बहन ... दोस्‍त .. गुरू को खोया है तो कई देशों ने अपने राजपरिवार के सदस्‍यों से लेकर अनेक राजनेताओं को खोया है। किसी ने विश्‍वास खोया है तो किसी ने ईमान खोया है। जनता ने राजनेताओं और प्रशासनिक व्‍यवस्‍थाओं के प्रति विश्‍वास को खोया है तो इन राजनेताओं और प्रशासकों में से कईयों ने अपने परिवार के सदस्‍यों को खोया है। किसी ने जेवर, किसी ने घर तो किसी ने जमापूंजी को खोया है। 

सीखा है ... अकेला आया था, अकेला ही जाएगा। कोई पैसा जि़ंदगी न लौटा पाएगा। आज ही जीवन है। वर्तमान में जीयो और भविष्‍य की चिंता मत करो। लेकिन, चिंतामुक्‍त वर्तमान जीने के लिए विभिन्‍न बीमा पॉलिसयों के माध्‍यम से भविष्‍य के प्रति चिंताओं की लगाम कसकर बांध देनी चाहिए। यूँ तो हर घर मंदिर होता है जिसमें ईश्‍वर के बनाये इंसान रहते हैं, लेकिन हर घर में एक मंदिर जरूर होता है ... इसी एक मंदिर की तरह अब से हर घर में एक आत्‍मनिर्भर मेडिकल व्‍यवस्‍था भी होनी चाहिए। हर घर में कम से कम एक ऑक्‍सीजन सिलेंडर, दो-तीन ऑक्‍सीजन मास्‍क, एक ऑक्‍सीमीटर (शरीर में ऑक्‍सीजन का स्‍तर मापने वाला उपकरण), एक थर्मल स्‍कैनर (शरीर का तापमान मापने वाला उपकरण), एक स्ट्रिमर (फेफड़ों के ब्‍लॉकेज को खोलने और ऑक्‍सीजन ग्रहण कर  पूरे शरीर में  पहुंचाने में उपयोगी उपकरण),  मूलभूत सामान्‍य दवाईयां (विद्वत डॉक्‍टर के सुझाव अनुसार) अवश्‍य होनी चाहिएं। इसके साथ-साथ, हर घर में कम से कम एक-एक फायर इंस्टिंयूशर (अग्निशमन उपकरण) भी जरूर होना चाहिए जो आग लगने जैसी स्थिति को शुरू में ही संभाल ले या अग्निशमन दल के आने तक आग को नियंत्रित रख सके। जिस एक या दो व्‍यक्ति विशेष  की कमाई से घर चलता हो, उन्‍हें अपनी क्षमतानुसार जीवन बीमा और चल-अचल संपत्ति बीमा भी करवाना चाहिए। यकीन मानिए, इन सबसे आप अपने आप को मानसिक और शारीरिक रूप से सशक्‍त महसूस करेंगे और विपरीत काल में यह आंतरिक सशक्‍तता इम्‍यूनिटी को बनाये रखने का काम करेगी। हम भगवान के बनाये संसार रूपी उस हवाई जहाज के यात्री हैं जिसकी परिचारिका (एअर होस्‍टेस) यह कहती है कि आपातकालीन स्थिति में ऑक्‍सीजन की मात्रा कम होने पर सबसे पहले खुद ऑक्‍सीजन मास्‍क लगायें फिर दूसरों को लगाने में मदद करें। यही जीवन की सच्‍चाई है, दूसरों के लिए करने के लिए पहले खुद के लिए करना होगा। 

ईश्‍वर का संबंध जीवात्‍मा से है और हमेशा रहेगा। ईश्‍वर ने हर जीवात्‍मा को शरीर रूपी वस्‍त्र दिया है जिसकी स्‍वच्‍छता और स्‍वस्‍थता का ध्‍यान रखना संबद्ध जीवात्‍मा का प्रथम दायित्‍व है क्‍योंकि इसी शरीर के कारण  ही जीवात्‍मा का लौकिक अस्तित्‍व है। अत: स्‍वस्‍थ शरीर में ही जीवात्‍मा निवास करती है और इस शरीर को हर तरह से स्‍वस्‍थ और सुरक्षित बनाये रखना प्रत्‍येक संबद्ध व्‍यक्ति ... व्‍यक्तियों के समूह 'परिवार' ... परिवारों के समूह 'समाज' और समाज के पालनहार राजा अर्थात 'सरकार' का नैतिक कर्तव्‍य है।

At its ground-breaking ceremony, he calls upon MPs to keep spirit of optimism alive around democracy by being always accountable to people and Constitution.Prime Minister Narendra Modi on Thursday said the new Parliament building, for which the ground-breaking ceremony was held, would channel and reflect the aspirations of 21st century India.

अपने अभूतपूर्व शिलान्‍यास समारोह में, उन्‍होंने सांसदों से आवाह्न किया कि वे लोगों और संसद के प्रति हमेशा जवाबदेह रहकर लोकतंत्र के प्रति आशावाद की भावना को जीवंत बनाये रखें। प्रधानमंत्री नरेन्‍द्र मोदी ने वीरवार को कहा कि नया संसद भवन, जिसके लिए अभूतपूर्व शिलान्‍यास समारोह आयोजित किया गया था, 21वीं सदी के भारत की आकांक्षाओं को आगे बढ़ाने और दर्शाने का काम करेगा।  

 Mr. Modi said, “The new building will be the amalgamation of the new and the ancient, and reflects also the spirit of fostering change in oneself adapting to changing circumstances. Our Constitution was framed and given to us in the current parliament building and it is the repository of much of our democratic legacy but it is important to be realistic as well. Over the last 100 years, several modifications have been made to the current building to the point where even the building requires rest. Which is why the decision was taken to construct a new Parliament building”.

 श्री मोदी ने कहा, ‘’नया भवन नवीनता और प्राचीनता का संगम होगा और बदलती परिस्थितियों के अनुरूप स्‍वयं में कायम बदलाव की भावना को भी दर्शाता है। मौजूदा संसद भवन में हमारा संविधान तैयार तथा हमें सौंपा गया था और यह हमारी अधिकांश लोकतांत्रिक विरासत का संग्रहगार है परंतु इसके साथ ही हमारा यथार्थवादी होना भी महत्‍वपूर्ण है। पिछले 100 सालों में, मौजूदा भवन में इस हद तक कई बदलाव किए गए हैं कि जहां भवन को भी आराम की जरूरत है। इन सबके कारण नए संसद भवन के निर्माण का निर्णय लिया गया था।

अंतरराष्‍ट्रीय अनुवाद दिवस – 2020 

अंतरराष्‍ट्रीय सहयोग, सुरक्षा, आर्थिक विकास, सामाजिक प्रगति, मानवाधिकारों तथा विश्‍व शांति के उद्देश्‍यों को लेकर 24 अक्‍तूबर 1945 को स्‍थापित सर्वोच्‍च वैश्विक संस्‍था संयुक्‍त राष्‍ट्र (यूएन) के 193 सदस्‍य देश हैं। यूएन को विश्‍व संसद भी कहा जाता है। इस विश्‍व संसद में बनाये जाने वाले कानून और नियम इस संस्‍था के सभी सदस्‍य-देशों पर लागू होते हैं। इस संस्‍था के सभी सदस्‍य-देशों की अपनी-अपनी राजभाषा है जिसमें उनके देश की शासन व्‍यवस्‍था काम करती है। प्रत्‍येक सदस्‍य-देश की राजभाषा इस संस्‍था की राजभाषा हो ऐसा व्‍यावहारिक रूप से संभव नहीं है। फलस्‍वरूप, वर्तमान में यूएन की छह राजभाषाएँ हैं – अरबी, चीनी (मंदारिन), अंग्रेज़ी, फ्रेंच, रूसी और स्‍पेनिश। यूएन का कामकाज इन छह भाषाओं के भाषांतरकारों और अनुवादकों की सहायता से किया जाता है। यूएन की बैठकों में इसके सदस्‍य-देशों के प्रतिनिधि अपनी-अपनी भाषा में अपने विचार प्रकट कर सकते हैं। लेकिन, यदि किसी सदस्‍य-देश का प्रतिनिधि यूएन की आधिकारिक छह भाषाओं से इतर किसी अन्‍य भाषा में अपना वक्‍तव्‍य देता है तो संबंधित देश के अधिकारियों द्वारा उस वक्‍तव्‍य का यूएन की छह भाषाओं में से किसी एक भाषा में वक्‍तव्‍य का लिखित पाठ यूएन सचिवालय को उपलब्‍ध करवाना होता है। ऐसे प्रतिनिधियों के वक्‍तव्‍य भाषांतरकारों के माध्‍यम से यूएन की छह भाषाओं में समानांतर रूप से उपलब्‍ध करवाये जाते हैं। यूएन की बैठकों में वक्‍तव्‍य देने वाले सदस्‍य-देशों के प्रतिनिधियों के वक्‍तव्‍यों को यूएन की भाषाओं में लिखित एवं ऑडियो रूप में संग्रहीत किया जाता है।

इस तरह, वैश्विक संस्‍था यूएन अनुवाद के माध्‍यम से सभी सदस्‍य देशों को एक मंच पर स्‍थापित किए हुए है। यूएन की प्रासंगिकता एवं सफलता में अनुवाद की भूमिका को स्‍वीकार करते हुए, यूएन की आम सभा ने 24 मई 2017 को एक संकल्‍प (सं. 71/288) अंगीकृत करते हुए अनुवादकों के संरक्षक संत माने जाने वाले बाइबिल के अनुवादक संत जेरोम की पुण्‍यतिथि 30 सितंबर को अंतरराष्‍ट्रीय अनुवाद दिवस घोषित किया था। आपको यह जानकर आश्‍चर्य होगा कि यूएन विश्‍व में भाषा एवं अनुवाद से जुड़े विशेषज्ञों के सबसे बड़े नियोक्‍ताओं में से एक है। 

बहुभाषा-भाषी विश्‍व के देशों के बीच परस्‍पर राजनयिक, सांस्‍कृतिक एवं व्‍यापारिक संबंधों के निर्माण में अनुवादक और भाषांतरकार महत्‍वपूर्ण भूमिका अदा कर रहे हैं। बाइबिल में कहा गया है कि सृष्टि के प्रारंभ में संपूर्ण विश्‍व में एक ही भाषा और बोली थी और लोग संगठित होकर असंभव को संभव बनाने में सफलता पाने की ओर बढ़ रहे थे तो परमेश्‍वर ने एकभाषी मनुष्‍य जाति के बीच भाषा और स्‍थान भेद पैदा कर दिया और फलस्‍वरूप विश्‍व में अनेक भाषाओं और बोलियों का उदय हुआ। यदि हम इस घटना को स्‍वीकार करते हैं तो विश्‍व के बहुभाषी लोगों को आपस में वापिस एकसू्त्र में पिरोने का चमत्‍कारी कार्य अनुवादकों और भाषांतरकारों के माध्‍यम से संपन्‍न हो रहा है। अत: विश्‍व के अनुवादक और भाषांतरकार प्रशंसा और सम्‍मान के पात्र हैं। 

यदि हम अंतरराष्‍ट्रीय अनुवाद दिवस को भारतीय परिप्रेक्ष्‍य में देखें तो पाएंगे कि भाषायी दृष्टि से भारत स्‍वयं में ही एक संपूर्ण विश्‍व है। भारत में अनेकानेक भाषाएँ और बोलियां बोली जाती हैं। भारत के विभिन्‍न भाषाओं के बोलने वाले लोगों को आपस में जोड़ने का कार्य अनुवादक और भाषांतरकार कर रहे हैं।  विश्‍व व्‍यापार के क्षेत्र में भारत अग्रणी देशों में शुमार है। भारत की कंपनियां विश्‍व की अनेक कंपनियों के साथ व्‍यापार कर देश के विदेशी मुद्रा भंडार को भरने में महत्‍वपूर्ण भूमिका अदा कर रही हैं। भारतीय तथा बहुराष्‍ट्रीय कंपनियों ने अनुवाद और भाषांतरण का सबसे अधिक सहारा लिया है। आज देश-विदेश की बड़ी कंपनियां अपने ग्राहकों की भाषा में अपने उत्‍पाद बेचकर मुनाफ़ा कमा रही हैं। व्‍यापारियों की भाषा होती है पैसा, उन्‍हें जिस भाषा के माध्‍यम से ज्‍यादा मुनाफ़ा होगा वे उसी भाषा में व्‍यापार करेंगे। यही कारण है कि आज मीडिया के सभी माध्‍यमों पर हिंदी एवं भारतीय भाषाओं के विज्ञापनों की भरमार है। अत: यदि अनुवादकों और भाषांतरकारों को भारतीय अर्थव्‍यवस्‍था की संपन्‍नता के रथ का सारथी कहा जाए तो अतिश्‍योक्ति नहीं होगी। भारत में राजनीतिक, प्रशासनिक, आर्थिक, शैक्षणिक, साहित्यिक, बौद्धिक, सामाजिक, रोज़गार आदि क्षेत्रों की व्‍यवस्‍था का प्रबंधन अनुवादकों एवं भाषांतरकारों के योगदान से ही संभव हो रहा है। 

इस तरह जब भारत सहित विश्‍व के सर्वांगीण विकास में अनुवादकों और भाषांतरकारों की भूमिका सिद्ध हो चुकी है तो कुशल अनुवादकों एवं भाषांतरकारों के निर्माण और उनके कल्‍याण के लिए निम्‍नलिखित कदम उठाये जाने की आवश्‍यकता है:-

1. शैक्षणिक संस्‍थानों द्वारा अनुवाद एवं भाषांतरण के पाठ्यक्रम व्‍यवहारपरक और भारत सहित विश्‍व बाज़ार की जरूरतों को ध्‍यान में रखते हुए तैयार किए जाने चाहिएं। इसके साथ ही, इन पाठ्यक्रमों के विद्यार्थियों को इंटर्नशिप करवाई जानी चाहिए और तकनीकी ज्ञान दिया जाना चाहिए।

2.  भारत सहित विश्‍व के अनुवादकों एवं भाषांतरकारों का राष्‍ट्रीय/वैश्विक रजिस्‍टर बनाया जाना चाहिए ताकि सेवा-प्राप्‍तकर्ताओं और सेवा-प्रदाताओं के बीच सीधे संपर्क स्‍थापित किया जा सके।

3. भाषा एवं अनुवाद-सेवी संस्‍थाओं की स्‍वायत्‍ता को बनाये रखते हुए उनका परिसंघ बनाये जाने की आवश्‍यकता है ताकि अत्‍यंत महत्‍वपूर्ण मामलों में सर्वसम्‍मति बनाई जा सके।

4. शिक्षण-प्रशिक्षण सामग्री और प्रतियो‍गी परीक्षाओं के प्रश्‍नपत्रों के उत्‍कृष्‍ट सुनिश्चित किए जाने चाहिएं ताकि विद्यार्थी और रोज़गार की दौड़ में शामिल अभ्‍यर्थी दोनों अपनी-अपनी पसंद की भाषाओं के माध्‍यम से शिक्षा और रोज़गार प्राप्‍त कर सकें।

5. अनुवाद एवं भाषांतरण और अनुवादकों एवं भाषांतरकारों से जुड़ी सभी जानकारियां एक ही वैश्विक मंच (वेबसाइट) पर उपलब्‍ध होनी चाहिएं जिनमें पाठ्यक्रम चलाने वाले संस्‍थानों की जानकारी, इंटर्नशिप करवाने वाली संस्‍थाओं की जानकारी, निजी एवं सरकारी क्षेत्रों में अंशकालिक एवं पूर्णकालिक भर्ती तथा स्‍वतंत्र (फ्रीलांस) कार्य के विज्ञापन, सभी भाषाओं एवं क्षेत्रों के शब्‍दकोश एवं मानक शब्‍दावलियां आदि।

अत: अंतरराष्‍ट्रीय अनुवाद दिवस-2020 के अवसर पर यूएन में भारत सहित विश्‍व के सभी सदस्‍य देशों को अनुवाद एवं भाषांतरण के क्षेत्र में विकास और कुशल अनुवादकों एवं भाषांतरकारों के निर्माण एवं कल्‍याण के लिए महत्‍वपूर्ण कदम उठाने चाहिएं। भारत सहित विश्‍व के सभी देशों में यह दिन भव्‍य तरीके से मनाया जाना चाहिए ताकि विश्‍व के लोगों का ध्‍यान आकर्षित किया जा सके और वे अनुवादकों और भाषांतरकारों के प्रति अपनी कृतज्ञता प्रकट कर सकें।

Union Minister for Consumer Affairs, Food & Public Distribution Shri Ram Vilas Paswan has said that the details of manufacturer, date of expiry, MRP and other details of the product should be legible and should be given on packages of all the products. He urged consumers to file complaints, if they found any information missing on the package of any product. He said that this will create deterrence in the minds of the manufacturers who indulge in unfair practices or pushing sub-standard products into the market.

Replying to media queries today during a Video press conference, Shri Paswan informed that the Department of Legal Metrology, Guntur in AP has registered a complaint against the pharmaceutical distributor of medicine ‘Seder OM’. Shri Paswan informed that as per the complaint received, the name of the Manufacturer, Helpline number and date of expiry are not visible. It is further alleged that the size of the numerals and letters of the declaration is less than 1 mm and not easily legible on the above medicine packages. He said that raids were conducted on the premises of the distributor and seller under section 15 of the Legal Metrology Act, 2009 and packets of the above medicine have been seized.

PRACTICAL TRANSLATION EXERCISE (English-Hindi) – 33 (16-08-2020) LEGAL TRANSLATION EXERCISE (END PART - IV)

The second application has been filed by the plaintiffs U/s 151 CPC seeking exemption from filing duly attested copy of affidavit.

Ld. Counsel for the plaintiffs has argued that the plaintiffs could not get the supporting affidavit, which was to be filed with the application U/o XV-A CPC 1908, attested by the Oath Commissioner and has prayed to exempt the plaintiffs from filing the same due to outbreak of COVID-19 on account of which the supporting affidavit could not be attested. Hence, it could not be filed.

Considering the abovesaid reason, the plaintiffs is exempted to file the supporting affidavit but it is ordered that plaintiffs shall file the same, when the court starts functioning regularly. Hence, the present application U/s 151 CPC seeking exemption from filing duly attested affidavit is allowed.

Now the third application has been filed by the plaintiffs U/s. 149 CPC, 1908 for deposit of court fee. Ld. Counsel for plaintiffs has argued that due to Coronavirus, the plaintiffs are not in a position to file court fee but he undertakes to deposit the same on reopening of the Courts. Hence, the application is allowed and plaintiffs are directed to file the court fee when the court start its functioning regularly. All the three applications are disposed off accordingly.

Defendant is directed to file Written Statement within two weeks from today by supplying advance copy to the plaintiff. Let the matter be fixed for filing written statement/further proceedings on 03.07.2020.

 Ld. Counsel for plaintiffs has also argued that the defendant be directed to deposit rent of Rs. 1,35,000/- for the month of March 2020 and mesne profits as Rs. 3,00,000/- per month from April 2020 till the decision of the suit.

On the other hand, Ld. Counsel for defendant has argued that security amount of Rs. 4,50,000/- is deposited with the plaintiffs and due to outbreak of pandemic COVID-19, due to lockdown, manufacturing has stopped, so, inflow of money is nil and staff has to be paid their salary also. So, the rent can be adjusted from the security amount deposited with the plaintiffs.

Ld. Counsel for defendant has also argued that once fire broke out in the premises and all electrical repair work was done by the defendant and the plaintiffs told the defendant to adjust the said cost in the rent, which was never adjusted. Now, the said amount can be adjusted accordingly.

Arguments on behalf of both the parties have been heard.

Considering the abovesaid facts and circumstances, in my opinion, the court can take judicial notice of the fact regarding the spread of COVID-19 and the stand taken by the defendant is plausible. In the present matter, it has also been pointed out by Ld. Counsel for the defendant that plaintiffs are already in possession of security amount of Rs. 4,50,000/-. The mere fact that the plaintiffs are having the security amount of Rs. 4,50,000/- in her possession, no loss shall be suffered by the plaintiffs, if the direction to deposit the rent is not made due to outbreak of pandemic COVID-19. Hence, the application filed by plaintiffs U/o XV-A CPC 1908, for deposit of rent/mesne profit is dismissed.
