अंतरराष्‍ट्रीय अनुवाद दिवस – 2020 

अंतरराष्‍ट्रीय सहयोग, सुरक्षा, आर्थिक विकास, सामाजिक प्रगति, मानवाधिकारों तथा विश्‍व शांति के उद्देश्‍यों को लेकर 24 अक्‍तूबर 1945 को स्‍थापित सर्वोच्‍च वैश्विक संस्‍था संयुक्‍त राष्‍ट्र (यूएन) के 193 सदस्‍य देश हैं। यूएन को विश्‍व संसद भी कहा जाता है। इस विश्‍व संसद में बनाये जाने वाले कानून और नियम इस संस्‍था के सभी सदस्‍य-देशों पर लागू होते हैं। इस संस्‍था के सभी सदस्‍य-देशों की अपनी-अपनी राजभाषा है जिसमें उनके देश की शासन व्‍यवस्‍था काम करती है। प्रत्‍येक सदस्‍य-देश की राजभाषा इस संस्‍था की राजभाषा हो ऐसा व्‍यावहारिक रूप से संभव नहीं है। फलस्‍वरूप, वर्तमान में यूएन की छह राजभाषाएँ हैं – अरबी, चीनी (मंदारिन), अंग्रेज़ी, फ्रेंच, रूसी और स्‍पेनिश। यूएन का कामकाज इन छह भाषाओं के भाषांतरकारों और अनुवादकों की सहायता से किया जाता है। यूएन की बैठकों में इसके सदस्‍य-देशों के प्रतिनिधि अपनी-अपनी भाषा में अपने विचार प्रकट कर सकते हैं। लेकिन, यदि किसी सदस्‍य-देश का प्रतिनिधि यूएन की आधिकारिक छह भाषाओं से इतर किसी अन्‍य भाषा में अपना वक्‍तव्‍य देता है तो संबंधित देश के अधिकारियों द्वारा उस वक्‍तव्‍य का यूएन की छह भाषाओं में से किसी एक भाषा में वक्‍तव्‍य का लिखित पाठ यूएन सचिवालय को उपलब्‍ध करवाना होता है। ऐसे प्रतिनिधियों के वक्‍तव्‍य भाषांतरकारों के माध्‍यम से यूएन की छह भाषाओं में समानांतर रूप से उपलब्‍ध करवाये जाते हैं। यूएन की बैठकों में वक्‍तव्‍य देने वाले सदस्‍य-देशों के प्रतिनिधियों के वक्‍तव्‍यों को यूएन की भाषाओं में लिखित एवं ऑडियो रूप में संग्रहीत किया जाता है।

इस तरह, वैश्विक संस्‍था यूएन अनुवाद के माध्‍यम से सभी सदस्‍य देशों को एक मंच पर स्‍थापित किए हुए है। यूएन की प्रासंगिकता एवं सफलता में अनुवाद की भूमिका को स्‍वीकार करते हुए, यूएन की आम सभा ने 24 मई 2017 को एक संकल्‍प (सं. 71/288) अंगीकृत करते हुए अनुवादकों के संरक्षक संत माने जाने वाले बाइबिल के अनुवादक संत जेरोम की पुण्‍यतिथि 30 सितंबर को अंतरराष्‍ट्रीय अनुवाद दिवस घोषित किया था। आपको यह जानकर आश्‍चर्य होगा कि यूएन विश्‍व में भाषा एवं अनुवाद से जुड़े विशेषज्ञों के सबसे बड़े नियोक्‍ताओं में से एक है। 

बहुभाषा-भाषी विश्‍व के देशों के बीच परस्‍पर राजनयिक, सांस्‍कृतिक एवं व्‍यापारिक संबंधों के निर्माण में अनुवादक और भाषांतरकार महत्‍वपूर्ण भूमिका अदा कर रहे हैं। बाइबिल में कहा गया है कि सृष्टि के प्रारंभ में संपूर्ण विश्‍व में एक ही भाषा और बोली थी और लोग संगठित होकर असंभव को संभव बनाने में सफलता पाने की ओर बढ़ रहे थे तो परमेश्‍वर ने एकभाषी मनुष्‍य जाति के बीच भाषा और स्‍थान भेद पैदा कर दिया और फलस्‍वरूप विश्‍व में अनेक भाषाओं और बोलियों का उदय हुआ। यदि हम इस घटना को स्‍वीकार करते हैं तो विश्‍व के बहुभाषी लोगों को आपस में वापिस एकसू्त्र में पिरोने का चमत्‍कारी कार्य अनुवादकों और भाषांतरकारों के माध्‍यम से संपन्‍न हो रहा है। अत: विश्‍व के अनुवादक और भाषांतरकार प्रशंसा और सम्‍मान के पात्र हैं। 

यदि हम अंतरराष्‍ट्रीय अनुवाद दिवस को भारतीय परिप्रेक्ष्‍य में देखें तो पाएंगे कि भाषायी दृष्टि से भारत स्‍वयं में ही एक संपूर्ण विश्‍व है। भारत में अनेकानेक भाषाएँ और बोलियां बोली जाती हैं। भारत के विभिन्‍न भाषाओं के बोलने वाले लोगों को आपस में जोड़ने का कार्य अनुवादक और भाषांतरकार कर रहे हैं।  विश्‍व व्‍यापार के क्षेत्र में भारत अग्रणी देशों में शुमार है। भारत की कंपनियां विश्‍व की अनेक कंपनियों के साथ व्‍यापार कर देश के विदेशी मुद्रा भंडार को भरने में महत्‍वपूर्ण भूमिका अदा कर रही हैं। भारतीय तथा बहुराष्‍ट्रीय कंपनियों ने अनुवाद और भाषांतरण का सबसे अधिक सहारा लिया है। आज देश-विदेश की बड़ी कंपनियां अपने ग्राहकों की भाषा में अपने उत्‍पाद बेचकर मुनाफ़ा कमा रही हैं। व्‍यापारियों की भाषा होती है पैसा, उन्‍हें जिस भाषा के माध्‍यम से ज्‍यादा मुनाफ़ा होगा वे उसी भाषा में व्‍यापार करेंगे। यही कारण है कि आज मीडिया के सभी माध्‍यमों पर हिंदी एवं भारतीय भाषाओं के विज्ञापनों की भरमार है। अत: यदि अनुवादकों और भाषांतरकारों को भारतीय अर्थव्‍यवस्‍था की संपन्‍नता के रथ का सारथी कहा जाए तो अतिश्‍योक्ति नहीं होगी। भारत में राजनीतिक, प्रशासनिक, आर्थिक, शैक्षणिक, साहित्यिक, बौद्धिक, सामाजिक, रोज़गार आदि क्षेत्रों की व्‍यवस्‍था का प्रबंधन अनुवादकों एवं भाषांतरकारों के योगदान से ही संभव हो रहा है। 

इस तरह जब भारत सहित विश्‍व के सर्वांगीण विकास में अनुवादकों और भाषांतरकारों की भूमिका सिद्ध हो चुकी है तो कुशल अनुवादकों एवं भाषांतरकारों के निर्माण और उनके कल्‍याण के लिए निम्‍नलिखित कदम उठाये जाने की आवश्‍यकता है:-

1. शैक्षणिक संस्‍थानों द्वारा अनुवाद एवं भाषांतरण के पाठ्यक्रम व्‍यवहारपरक और भारत सहित विश्‍व बाज़ार की जरूरतों को ध्‍यान में रखते हुए तैयार किए जाने चाहिएं। इसके साथ ही, इन पाठ्यक्रमों के विद्यार्थियों को इंटर्नशिप करवाई जानी चाहिए और तकनीकी ज्ञान दिया जाना चाहिए।

2.  भारत सहित विश्‍व के अनुवादकों एवं भाषांतरकारों का राष्‍ट्रीय/वैश्विक रजिस्‍टर बनाया जाना चाहिए ताकि सेवा-प्राप्‍तकर्ताओं और सेवा-प्रदाताओं के बीच सीधे संपर्क स्‍थापित किया जा सके।

3. भाषा एवं अनुवाद-सेवी संस्‍थाओं की स्‍वायत्‍ता को बनाये रखते हुए उनका परिसंघ बनाये जाने की आवश्‍यकता है ताकि अत्‍यंत महत्‍वपूर्ण मामलों में सर्वसम्‍मति बनाई जा सके।

4. शिक्षण-प्रशिक्षण सामग्री और प्रतियो‍गी परीक्षाओं के प्रश्‍नपत्रों के उत्‍कृष्‍ट सुनिश्चित किए जाने चाहिएं ताकि विद्यार्थी और रोज़गार की दौड़ में शामिल अभ्‍यर्थी दोनों अपनी-अपनी पसंद की भाषाओं के माध्‍यम से शिक्षा और रोज़गार प्राप्‍त कर सकें।

5. अनुवाद एवं भाषांतरण और अनुवादकों एवं भाषांतरकारों से जुड़ी सभी जानकारियां एक ही वैश्विक मंच (वेबसाइट) पर उपलब्‍ध होनी चाहिएं जिनमें पाठ्यक्रम चलाने वाले संस्‍थानों की जानकारी, इंटर्नशिप करवाने वाली संस्‍थाओं की जानकारी, निजी एवं सरकारी क्षेत्रों में अंशकालिक एवं पूर्णकालिक भर्ती तथा स्‍वतंत्र (फ्रीलांस) कार्य के विज्ञापन, सभी भाषाओं एवं क्षेत्रों के शब्‍दकोश एवं मानक शब्‍दावलियां आदि।

अत: अंतरराष्‍ट्रीय अनुवाद दिवस-2020 के अवसर पर यूएन में भारत सहित विश्‍व के सभी सदस्‍य देशों को अनुवाद एवं भाषांतरण के क्षेत्र में विकास और कुशल अनुवादकों एवं भाषांतरकारों के निर्माण एवं कल्‍याण के लिए महत्‍वपूर्ण कदम उठाने चाहिएं। भारत सहित विश्‍व के सभी देशों में यह दिन भव्‍य तरीके से मनाया जाना चाहिए ताकि विश्‍व के लोगों का ध्‍यान आकर्षित किया जा सके और वे अनुवादकों और भाषांतरकारों के प्रति अपनी कृतज्ञता प्रकट कर सकें।

PRACTICAL (MEDIA) TRANSLATION EXERCISE (English-Hindi) – 34 (22-08-2020)

Union Minister for Consumer Affairs, Food & Public Distribution Shri Ram Vilas Paswan has said that the details of manufacturer, date of expiry, MRP and other details of the product should be legible and should be given on packages of all the products. He urged consumers to file complaints, if they found any information missing on the package of any product. He said that this will create deterrence in the minds of the manufacturers who indulge in unfair practices or pushing sub-standard products into the market.

Replying to media queries today during a Video press conference, Shri Paswan informed that the Department of Legal Metrology, Guntur in AP has registered a complaint against the pharmaceutical distributor of medicine ‘Seder OM’. Shri Paswan informed that as per the complaint received, the name of the Manufacturer, Helpline number and date of expiry are not visible. It is further alleged that the size of the numerals and letters of the declaration is less than 1 mm and not easily legible on the above medicine packages. He said that raids were conducted on the premises of the distributor and seller under section 15 of the Legal Metrology Act, 2009 and packets of the above medicine have been seized.

PRACTICAL TRANSLATION EXERCISE (English-Hindi) – 33 (16-08-2020) LEGAL TRANSLATION EXERCISE (END PART - IV)

The second application has been filed by the plaintiffs U/s 151 CPC seeking exemption from filing duly attested copy of affidavit.

Ld. Counsel for the plaintiffs has argued that the plaintiffs could not get the supporting affidavit, which was to be filed with the application U/o XV-A CPC 1908, attested by the Oath Commissioner and has prayed to exempt the plaintiffs from filing the same due to outbreak of COVID-19 on account of which the supporting affidavit could not be attested. Hence, it could not be filed.

Considering the abovesaid reason, the plaintiffs is exempted to file the supporting affidavit but it is ordered that plaintiffs shall file the same, when the court starts functioning regularly. Hence, the present application U/s 151 CPC seeking exemption from filing duly attested affidavit is allowed.

Now the third application has been filed by the plaintiffs U/s. 149 CPC, 1908 for deposit of court fee. Ld. Counsel for plaintiffs has argued that due to Coronavirus, the plaintiffs are not in a position to file court fee but he undertakes to deposit the same on reopening of the Courts. Hence, the application is allowed and plaintiffs are directed to file the court fee when the court start its functioning regularly. All the three applications are disposed off accordingly.

Defendant is directed to file Written Statement within two weeks from today by supplying advance copy to the plaintiff. Let the matter be fixed for filing written statement/further proceedings on 03.07.2020.

 Ld. Counsel for plaintiffs has also argued that the defendant be directed to deposit rent of Rs. 1,35,000/- for the month of March 2020 and mesne profits as Rs. 3,00,000/- per month from April 2020 till the decision of the suit.

On the other hand, Ld. Counsel for defendant has argued that security amount of Rs. 4,50,000/- is deposited with the plaintiffs and due to outbreak of pandemic COVID-19, due to lockdown, manufacturing has stopped, so, inflow of money is nil and staff has to be paid their salary also. So, the rent can be adjusted from the security amount deposited with the plaintiffs.

Ld. Counsel for defendant has also argued that once fire broke out in the premises and all electrical repair work was done by the defendant and the plaintiffs told the defendant to adjust the said cost in the rent, which was never adjusted. Now, the said amount can be adjusted accordingly.

Arguments on behalf of both the parties have been heard.

Considering the abovesaid facts and circumstances, in my opinion, the court can take judicial notice of the fact regarding the spread of COVID-19 and the stand taken by the defendant is plausible. In the present matter, it has also been pointed out by Ld. Counsel for the defendant that plaintiffs are already in possession of security amount of Rs. 4,50,000/-. The mere fact that the plaintiffs are having the security amount of Rs. 4,50,000/- in her possession, no loss shall be suffered by the plaintiffs, if the direction to deposit the rent is not made due to outbreak of pandemic COVID-19. Hence, the application filed by plaintiffs U/o XV-A CPC 1908, for deposit of rent/mesne profit is dismissed.

PRACTICAL TRANSLATION EXERCISE (English-Hindi) – 31 (13-08-2020) LEGAL TRANSLATION EXERCISE (PART - II)

It is averred in the plaint that the defendant did not pay the rent in time as agreed in the Lease Deed. Plaintiff states that it came to the notice of the plaintiffs that the defendant has assigned, sublet and parted with possession to one M/s. Bold Brewing Private Ltd.

Ld. Counsel for plaintiff has argued that on 28.03.2020, a legal notice was sent to the defendant terminating the lease deed on account of violating clause 17 of the Lease Deed. On 04.04.2020, a reply was received from defendant admitting that the registered office of M/s. Bold Brewing (P) Ltd. was that of the tenanted premises and is subsidiary of the defendant. It was also admitted in the reply that no rent has been paid for the month of March, 2020.

 It is further stated that apart from March, 2020, the rent as well as maintenance charges and electricity bill for the month of April, 2020 has also not been paid. The plaintiff no.1 is a senior citizen being 70 years old and her source of livelihood is only rental income. The plaintiffs have prayed to direct the defendant to hand over the vacant peaceful possession of the premises i.e. T-95A, Third Floor, M. No.161/A/2, C.L. House, Gautam Nagar Complex, New Delhi; to pass decree for recovery of rent as Rs. 1,35,000/- for the month of March 2020; to pass a decree of Rs. 3,00,000/- as unauthorized use and occupation charges of the premises for the month of April 2020 and further enquiry U/o 20 Rule 12 CPC, 1908 may be assessed till the date of handing over of vacant possession of the premises by the defendant to the plaintiffs. Hence, the suit has been filed.

As far as application U/o XV-A CPC 1908, for deposit of rent/mesne profit is concerned, Ld. Counsel for plaintiff has argued that plaintiff no1 is a senior citizen and the rental income is the only source of income for her livelihood and she is suffering from various old age ailments. The plaintiff no.1 has to buy medicine and has to pay for domestic help for which she is completely depended on rental income.

PRACTICAL TRANSLATION EXERCISE (English-Hindi) – 30 (11-08-2020)

 Legal Translation Exercise (Part - I) 

Vide this order, I shall decide urgent application moved on behalf of plaintiffs U/s. XV-A CPC, 1908, as applicable to Delhi, for deposit of rent/mesne profits. The application is annexed with two other applications i.e. application U/s. 151 CPC, 1908 for exemption from filing attested copy of affidavits and another application U/s 149 CPC, 1908 for deposit of court fee.

The application U/s. XV-A CPC, 1908, has been filed by the plaintiffs directing defendant to deposit rent of Rs. 1,35,000/- for the month of March, 2020 and also directing the defendant to deposit mesne profit at the rate of Rs. 3,00,000/- per month for April, 2020 and also directing the defendant to keep on depositing mesne profit for the subsequent months till decision of the suit.

Before dealing with the application, a brief fact of the suit is reproduced herein:

Ld. Counsel for plaintiffs states that plaintiffs are the owners of third floor property bearing no. T-95A, M.No. 161/A/2, C.L. House, Gautam Nagar Complex, New Delhi, with the following ratio:

a. Plaintiff no.1: 80%’

b. Plaintiff no.2: 20%

It is stated by plaintiffs that the aforementioned property was let out to the defendant for its office use at the monthly rent of Rs. 1,35,000/-, which was to be paid on or before 7th day of each calendar month in advance. Plaintiff states that it was mentioned in the Lease Deed that if the lessee does not make the payment of rent for the month within the stipulated time the lessee will pay the rent with interest @ 24% per annum to the lessors. Plaintiff further states that it is mentioned in the Lease Deed that if the lessee does not pay the rent for continuously two months, the lessors shall have the absolute rights to terminate the lease by giving 15 days notice in writing to the lessee; the Lease Deed commenced from 12.10.2017 and was valid for five years i.e. 11.10.2022; that the lessee shall not assign, sublet or part with the possession of the said premises or a portion thereof to anyone else.

Shri Ravi Shankar Prasad, Union Minister of Electronics &IT, Communications and Law & Justice, said that Government of India has been taking measures on priority to provide connectivity in the far flung, difficult, border areas of strategic importance, so as to ensure better quality of life to the people as well as to those who are working in these areas.

Speaking to media today after the inauguration of a submarine Optical Fiber Cable of length of 2300 kms between Chennai and Andaman Nicobar at a cost of Rs.1,224 crores, by Prime Minister Shri Narendra Modi.

Elaborating the various projects being implemented by Department of Telecommunications Shri Prasad  spoke about various projects being implemented by the Department of Telecommunications to provide connectivity in remote and difficult areas Shri Prasad informed that  a tender for 354 uncovered villages in the strategic, remote  and border areas of the country has been finalised and is under implementation in  144 villages of the the Union Territories of Jammu & Kashmir and Ladakh and remaining villages in the States of Bihar, Rajasthan, Uttrakhand, Himachal Pradesh and other priority areas of Gujarat .  These villages have been strategically choosen to cover border area connectivity on mobile. After commissioning of these villages, there will be no uncovered villages in UTs of J&K, Ladakh for mobile connectivity.  Satellite based DSPTs (Digital Satellite Phone Terminal) are  also being provided at 1347 sites for Army, BRO, BSF, CRPF, ITBP, SSB etc.  Out of which 183 sites are already commissioned and remaining are in process. 

The Union Minister further told that Department  of Telecommunications is also  working on providing mobile connectivity in villages of 24 Aspirationsal districts of Bihar, Uttar Pradesh, Rajasthan and Madhya Pradesh and remaining 44 Aspirational Districts for 7287 uncovered villages in  Chhatisgarh, Odisha, Jharkhand, Andhra Pradesh  will also be covered for which government approval is under submission.

It has come to notice of Ministry of Railways that one organization by name of “Avestran Infotech” having  website address www.avestran.in has given an advertisement in a prominent  news paper  on 8th  August 2020 calling for applications against a total number of 5285 number of post in eight categories on outsourcing basis on Indian Railways on 11 years contract. The applicants have been asked to deposit Rs.750/-as online fee and last date for receipt of applications has been mentioned as 10th  Sept.2020.

It may be informed to all that Advertisement for any Railway recruitment is always done by Indian Railways ONLY. No private agency has been authorized to do the same. The said issuance of said advertisement in question is illegal.

 In this connection, it is also clarified that the recruitment  of various categories of Group ‘C’ and erstwhile Group ‘D’ posts on Indian Railways is presently catered to by 21 Railway Recruitment Boards (RRBs) and 16 Railway Recruitment Cell (RRC) only and not by any other agency. Vacancies on Indian Railways are filled up by giving wide publicity through Centralized Employment Notifications (CENs). Railways 

On-line applications are called for from eligible candidates all over the country. CEN is published through Employment News/Rozgar Samachar and an indicative notice is given in National Daily and Local Newspapers. The CEN is also displayed on the official websites of RRBs/RRCs. The website address of all RRBs/RRCs is mentioned in the CEN. 

 It is further clarified that the Railways have not authorized any private agency as yet to do the recruitment of staff on its behalf as  alleged by the above named agency.

Railways has initiated it's investigation and is going on to take strictest action as per law against the above agency/persons involved in above matter.

High quality Face mask has been developed at the Bhabha Atomic Research Centre (BARC) Mumbai which is affiliated to Department of Atomic Energy. The mask was developed using HEPA filter and is expected to be cost-effective also. This was stated by Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh while citing some major achievements of the department during last one year.Pertinent to mention that Department of Atomic Energy has about 30 units which include R&D, academic institutions, aided hospitals, PSUs etc. Bhabha Atomic Research Centre, Mumbai founded by the legendary Scientist Dr Homi J. Bhabha also functions under the aegis of Department of Atomic Energy. Referring to some of the major activities and initiatives of the Department of Atomic Energy during the last one year, Dr Jitendra Singh complimented the scientific fraternity for coming to the support of society in the wake of COVID-19 pandemic. In addition to the high quality face mask, he informed that the Atomic/Nuclear scientists have also developed the protocol for re-use of Personal Protective Equipment (PPEs) subsequent to radiation sterilization. The SOP for the same is under consideration by the Union Ministry of Health and Family Welfare, he added.
